User Agreement Terms and Conditions

The PageStarts.Com website builder and related service(s) is provided to you under the specified terms and conditions found in this User Agreement Terms and Conditions and any user rules or policies of PageStarts.Com, also know as “the service provider”. You are herein known as and defined as “user or users” and any related term implied thereof. Modifications or changes to our policies appear as addendum items at least 10-days before they take effect.

I. By signing up to use our services, users represent and warrant that he or she is 18 years of age or older, or have parental or legal guardian permissions.

II. User agrees that all information provided must be true and accurate at the time of sign up and user agrees to update this information to keep it true, accurate, current and complete at all times within 24-hours of changes. If any information provided by Site Owner is untrue, inaccurate, not current or incomplete, the PageStarts.Com service provider has the right to terminate or suspend the user’s account and refuse any and all current or future use of all services and access to stored information.

III. User agrees that all services, tools, and content found, used and/or developed on the PageStarts.Com website are the SOLE PROPERTY of PageStarts.Com and cannot be duplicated or copied, sold, or resold at any time under strictly enforced penalties of Federal and State laws and provisions and copyright laws.

V. BY COMPLETING THE SIGN UP PROCESS AND CLICKING THE "I have read, understand and agree to the User Agreement” area, YOU AGREE TO BE BOUND BY THE User Agreement Terms and Conditions.

Users acknowledge and agree that they shall be solely responsible for all of the content of the web pages they build using the PageStarts.Com tools and services and that the service provider cannot and will not at any time for any reason be held responsible for illegal or immoral goods and services offered on the user’s web pages or Internet websites.

VIII. Users agree to display on any uploaded index.html the service provider’s contact information in the form of a single active link as “Developed at PageStarts.Com” (not including parenthesis).

IX. Users acknowledge and agree that the shopping cart provided at PageStarts.Com is the sole property of Mals-e.com and is subject to all restrictions, copyrights, polices, terms, and conditions of Mals-e.com.

X. Users agree not to hold PageStarts.Com responsible for any lost, damaged, stolen, or irretrievable web page content developed or stored on the PageStarts.Com website or web servers.

XI. PageStarts.Com give limited permission for users to copy and, or otherwise backup web pages and web pages content THEY HAVE PAID FOR to a disk or folder on their own system for the sole purpose of retrieving lost or otherwise irretrievable web pages they have developed at the PageStarts.Com website. This does not include any scripts, tools, or other content owned by PageStarts.Com which is fully protected and cannot be duplicated or copied, sold, or resold at any time under strictly enforced penalties of Federal and State laws and provisions and copyright laws.

XII. Users may use PageStarts.Com to develop websites for the purpose of resell under the same provisions and permission of User Agreement Terms and Conditions only if the person, persons, or company they sell the website to agrees to all terms and conditions of this User Agreement Terms and Conditions.

XIII. Resellers of websites developed at PageStarts.Com understand and assume full responsibility of for ensuring that User Agreement Terms and Conditions are agreed to by the person, persons, or company they sell the website to, and bears and assumes full legal responsibility for failures of compliance of the service providers User Agreement Terms and Conditions prior to and after transfer of the user account to any other entity.

XIV. Users agree that they will not hold responsible the service provider PageStarts.Com for 3rd party services providers listed within or off of the PageStarts.Com website.

XV. User represents and warrants that it will not engage in any activities that constitute or encourage a violation of any applicable law or regulation, including but not limited to the sale of illegal goods or the violation of export control or obscenity laws; that defame, impersonate or invade the privacy of any third party or entity; that infringe the rights of any third party, including but not limited to the intellectual property, business, contractual, or fiduciary rights of others; and that are in any way connected with the transmission of "junk mail" "Spam" or the unsolicited mass distribution of e-mail, or with any unethical marketing practices.

XVI. User confirms and warrants that it is the owner of or is duly authorized by the owner to use any trademark or name requested or allocated as its Domain Name when uploading websites from the service provider’s site. User further warrants that the user’s use or registration of any Domain Name constitutes infringement of any other entity’s Intellectual Property Rights.

XVII. User assumes full legal responsibility of use of images and content on their site and confirms and warrants that images and content are their own or used only with the owner’s permission.

XVIII. User agrees to be responsible for maintaining backup copies of their own site contents. The Service Provider will not be held liable for maintaining backups of said materials.

XIX. The Service Provider reserves the right to refuse to provide services to any user which it believes, in its sole discretion: (1) offers for sale goods or services, or uses or displays materials, that are illegal, obscene, vulgar, offensive, dangerous, or are otherwise inappropriate; (2) received a significant number of complaints for failing to be reasonably accessible to customers or timely fulfill customer orders; (4) has become the subject of a government complaint or investigation; or (5) has violated or threatens to violate these User Agreement Terms and Conditions or the spirit or intent thereof.

XX. User is not being granted any right to copy services or tools from the service provider or to use them on computers other than a server controlled by the service provider with the sole exception of uploading web pages they have purchased and built or purchased and edited at PageStarts.Com to a Internet hosting provider of their choice. Site Owner may not copy or use PageStarts.Com scripts, PageStarts.Com’s own web pages, parts of PageStarts.Com web pages or content therein, or images therein, other than content that originates from and is proprietary to the user through their purchase and development of user’s own web pages and content user develops within the web pages they have purchased

XXI. The user agrees not to hold the service provider responsible at any time for features, specifications, capabilities, functions, and other characteristics of the web builder and services provided at PageStarts.Com.

XXII. The user agrees that the sole remedy to any dissatisfaction of service is to terminate their user account.

XXIII.User acknowledges and agrees that content on the service provider website, including but not limited to text, software, music, sound, logos, trademarks, service marks, photographs, graphics, or video, is protected by copyright, trademark, patent, or other proprietary rights and laws, and may not be used in any manner unless otherwise specified other than as specified in User Agreement Terms and Conditions.

XXIV. User grants the service provider the right to maintain site owner's content on the service provider's servers at all times.

XXV. User shall not attempt to gain unauthorized access to any scripts, codes, content, Admin panels, website configurations, or servers controlled by or used by the service provider at any time.

XXVI. User agrees to pay a fee per page and an annual fee as set forth in the service provider’s fee schedule available within 5-business days upon request. All fees are payable in US dollars only and payable to PageStarts.Com or its appointed receiver. The Service Provider may also, alter its fee schedules and terms with no less than 10-days notice for all past, current, and new users.

TERMS

I. All User Agreement Terms and Conditions commence immediately on the date that user opens an account with the service provider, whether or not userclicks the "I have read, understand and agree to the User Agreement” area; and all users agree to be bound by the CLICKING THE "I have read, understand and agree to the User Agreement” area, YOU AGREE TO BE BOUND BY THE User Agreement Terms and Conditions. The service provider reserves the right to immediately suspend any customer access to the Site until such breach or noncompliance is cured, or permanently at its sole discretion.

II. The service provider may, but has no duty to, immediately terminate userand remove it from the service provider’s servers if the service provider in its sole discretion concludes that user is engaged in illegal activities, acts against the service provider, or the sale of illegal or harmful goods or services, or is engaged in activities or sales that may damage the rights of the service, the service provider, or others. Notwithstanding the foregoing, The Service Provider reserves the right, at its sole discretion, to immediately terminate service for any user. Any termination shall take effect immediately and user expressly agrees that it shall not have any opportunity to cure.

III. User expressly waives any statutory or other legal protection in conflict with CLICKING THE "I have read, understand and agree to the User Agreement” area, YOU AGREE TO BE BOUND BY THE User Agreement Terms and Conditions.

IV. The service provider reserves the right to delete from its servers any and all information and stored data contained in the user account and services, including but not limited to sign up information, web pages, web pagescontent and images, links, mailing lists.

V. The User Agreement Terms and Conditions shall survive any termination of the user account.

VI. User may cancel account at any time and cancellation will be deemed effective only when all outstanding payments due to the service provider are paid in full.

VII. Any outstanding balances due from user at any time are due and payable immediately, and are due prior to any services rendered by the service provider.

VIII. Users are not due refunds at any time including for any services pay for to the service provider once the service has been accessed or used.

PRIVACY

I. User grants that the service provider will maintain unrestricted access and information about, but not limited to user, user’s sign up information, user’s account, users web page(s), user’s web page(s) content.

II. User agrees that the service provider may disclose user information in the good faith belief that such action is reasonably necessary to comply with the law; to comply with legal process; to enforce User Agreement Terms and Conditions; to respond to claims that user is engaged in activities that violate the rights of third parties; or to protect the rights or interests of the service provider.

III. User agrees that the service provider may delete any and all user information with no less than 14 days written notice and may delete any and all user information and stored content at the end of any anniversary of the user sign up date, if renewal fees are not paid in full within 14 days or the user cannot be contacted and does not respond to email notices sent to the user account email address provided with the user sign up.

IV. User will establish a password for use on the service provider website to access to and use any and all services of the service provider, with the exception of the service provider’s DEMO which does not require password or sign up to use. User is entirely responsible for any and all activities which occur within user account and password. Site Owner agrees to keep its password confidential, to allow no unauthorized person or company to use its account for purposes that violate User Agreement Terms and Conditions, or to benefit the user or others without due payment for services offered and forservices rendered, and to notify the service provider promptly if user believes that the security of its account has been compromised.

V. User acknowledges and agrees that technical processing of user information is and may be required for the service to function; to conform to the technical requirements of connecting networks or the user’s web host; to conform to the technical requirements of the service and the service provider; to conform to other, similar technical requirements. User acknowledges and agrees that the service provider may access user’s account and its contents as necessary to identify or resolve technical problems or respond to complaints about the Service.

MAINTENANCE AND SUPPORT

I. User can obtain assistance with any technical difficulty that may arise in connection with user’s utilization of the services offered by the service provider by requesting assistance by email to support@pagestarts.com. The service provider reserves the right to establish limitations on the extent of such support, and the hours at which it is available.

II. User is solely responsible for obtaining and maintaining cart provider services, all domain names, and any other equipment needed for its access to and use of web builder, the web builder uploader, and the web builder shopping cart provider and the user shall be responsible for all charges and fees related thereto.

INDEMNITY

XXVII. Site Owner agrees to indemnify and hold harmless the service provider, and its parents, subsidiaries, affiliates, officers, directors, shareholders, employees and agents, from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of user’s conduct, user’s use of the services at PageStarts.Com, the goods or services offered at users site, any alleged violation of the User Agreement Terms and Conditions, or any alleged violation of any rights of another, including but not limited to user’s use of any content, trademarks, service marks, trade names, copyrighted or patented material, or other intellectual property used in connection with user’s site. The service provider reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by user, but doing so shall not excuse user’s indemnity obligations.

DISCLAIMER OF WARRANTIES AND LIABILITIES

ALLSERVICES AT PAGESTARTS.COM ARE PROVIDED"AS IS" AND "AS AVAILABLE"WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF SITE OWNER ABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. NEITHER THIS AGREEMENT OR ANY DOCUMENTATION FURNISHED UNDER IT IS INTENDED TO EXPRESS OR IMPLY ANY WARRANTY THAT THE PAGESTARTS.COM SERVICE WILL BE UNINTERRUPTED, TIMELY OR ERROR-FREE. THE FEATURES INCORPORATED INTO THE WEB BUILDER AND OTHER SERVICES HAS INHERENT LIMITATIONS AND USER MUST DETERMINE THAT THE SERVICES ADEQUATELY MEETS ITS REQUIREMENTS. USER ACKNOWLEDGES USE OF ALL SERVICES AND UPLOAD AND DOWNLOADS THROUGH USE OF THE SERVICE PROVIDER’S SERVICES IS DONE AT ITS OWN DISCRETION AND RISK AND THAT USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES TO ITS COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA. THE SERVICE PROVIDER, AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES AND AGENTS, SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES OR LEGAL THEORIES WHATSOEVER, FOR ANY LOSS OF BUSINESS, PROFITS OR GOODWILL, LOSS OF USE OR DATA, INTERRUPTION OF BUSINESS, OR FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER, EVEN IF THE SERVICE PROVIDER IS AWARE OF THE RISK OF SUCH DAMAGES, THAT RESULT IN ANY WAY FROM SITE OWNER USE OR INABILITY TO USE THE SERVICE PROVIDERS WEB BUILDER OR OTHER SERVICES, OR THAT RESULT FROM ERRORS, DEFECTS, OMISSIONS, DELAYS IN OPERATION OR TRANSMISSION, OR ANY OTHER FAILURE OF PERFORMANCE OF THE WEB BUILDER OR OTHER SERVICES PROVIDED BY THE SERVICE PROVIDER. THE SERVICE PROVIDER'S LIABILITY TO USER SHALL NOT, FOR ANY REASON, EXCEED THE AGGREGATE PAYMENTS ACTUALLY MADE BY SITE OWNER TO THE SERVICE PROVIDER OVER THE COURSE OF THE EXISTING TERM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIABILITIES, AND SOME EXCLUSIONS MAY NOT APPLY TO YOU.

NO RESALE OR ASSIGNMENT OF SERVICE

Site Owner agrees not to resell or assign or otherwise transfer its rights or obligations under User Agreement Terms and Conditions except within the express limitations of User Agreement Terms and Conditions, or with the express written consent of the service provider.

NOTICES

Any notices or communications under User Agreement Terms and Conditions shall be by electronic mail or in writing and shall be deemed delivered upon receipt only when receipt is acknowledged by the recipient if to the service provider. If to the user, such notices shall be addressed to the electronic or mailing address specified when user opens an account with the service provider
